Abstract

Eksistensi hukum Islam di Andalusia dapat dilihat pada tiga poin penting. Pertama, struktur pemerintahan Bani Nasr. Kedua, peranan politik fuqaha dalam mempertahankan supremasi hukum Islam. Ketiga, sistem hukum yang berlaku di Andalusia. Qadi al-Jama’ah merupakan bukti konkrit eksisnya pemberlakuan hukum Islam di Andalusia. Kewenangan Qadi        al-Jama’ah meliputi administrasi peradilan, mufti (konsultan hukum), musawir (konsultan), wuttaq (para perumus dan notaris), administrasi keagamaan dan waqaf, dan infeksi atas perdagangan yang menentukan harga, kualitas dan berat barang dagangan di pasar.
