Abstract

The substance of maqasid al-syariah is maslahah (welfare, benefit and utility). This means that the purpose of the Islamic law is to realize the benefit and protect human being from adventageus effects and social problems. A well-known Moslem scholar in discussing maqasid al-syariah is al-Syatibi. He says that the unification of Islamic law indicates the unification  of its origin and its aim. Therefore, al-Syatibi develops the concept of the intention of legislation based on his basic thought that the final aim of the institutionalization of Islamic law is the benefit of human being. The renewal of Islamic law is relevant with the concept of al-Syatibi’s intention of legislation. This is because the substance of the intention of legislation is to realize the benefit of human being and guarantee the Moslem’s happiness.
